Employer Compliance Action Plan
To manage the transition and avoid additional financial exposure, the following actions are recommended.
| Action | Compliance requirement |
| Verify factory particulars | Confirm the maximum number of workers and installed horsepower stated in the current licence. |
| Recalculate the fee | Compare the fee previously paid with the corresponding fee under Rule 75(1) of the Gujarat OSH Rules, 2025. |
| Review existing licences | Identify licences extending beyond 2025 and check whether a differential fee has been assessed. |
| Verify the portal demand | Reconcile the amount shown under “Fee Difference” with the licence particulars, payment history and applicable fee categories. |
| Complete payment | Where a differential is payable under the Directorate’s communication, arrange payment by 31 October 2026. |
| Retain evidence | Preserve the previous licence, fee receipts, revised fee calculation, portal demand and payment acknowledgement. |
| Update the compliance tracker | Record the revised statutory reference and applicable fee category for future licence renewals and amendments. |
Directorate’s Communication Dated 13 October 2026
The Office of the Director, Industrial Safety and Health, Gujarat, issued a communication bearing Outward No. DISH/IT/2026/913 to 965, dated 13 October 2026, regarding the revised fee structure.
The communication states that:
- New licence applications, renewals and licence amendments for periods after 2025 must be assessed under the OSHWC Code, 2020, and the associated Rules.
- Occupiers holding valid licences extending beyond 2025, for which fees were previously paid under the Factories Act, 1948, and the Gujarat Factories Rules, 1963, must pay the fee differential under the revised structure.
- The differential is payable online through the Directorate’s portal by following the path Public User Login → Fee Difference.
- The stated deadline for payment is 31 October 2026.
- Failure to pay by the deadline will attract an additional 25% of the differential fee for the respective year, as stated in the communication.
Portal: https://dish.gujarat.gov.in
The communication therefore makes the change relevant not only to factories applying for new licences or renewals, but also to occupiers whose existing licences remain valid beyond 2025.
Recommendation: Initiate a Gujarat factory licence fee review across all applicable units, prioritising existing licences and portal demands that may be subject to the 31 October 2026 deadline. This will support accurate budgeting, timely statutory payment and maintenance of auditable compliance records.
